Hi

We all have been hearing about PERM for last 12/16 months now.The latest I heard is its going to be implemented in Oct-04 & I read somewhere that its going to be implemented early next year

My question is , should we really depend on PERM for our LCA ?
For eg - I have like 16 months on my H1 period & I have filed LCA thrg state of CA last year.Its more than 1 year , & the case is still at State level.

In this case, Should I file 1 more LCA thrg some other employer /state ?I at least want my EAD by Oct-05 ( H1 B period )

Would appreciate some replies

By the way, PERM is for LC not LCA ...

--- You can always get H1 extensions beyond 6 year if any one company has filed LC for you 1 year before your 6 year limit !.. so you are fine as it is.

-- you can also file multiple LC (diff. employers / diff . states)..

-- 1 year & still in CA SESA, is it non RIR ??

Thank gp111.My case is RIR .I asked my attorney & I was told that they have not yet received any info.My case was filed on 5/15/03.By this time it should go to Fed level.

If I want to know the status of the case, what info should I ask to my attorney ?Will me calling the state offices help ?

Also whats the difference between LCA & LC ?

LC is LABOR CERTIFICATION for Employment Based Green Card. LCA is LABOR CONDITIONING APPROVAL for H1B.

CA SESA is processing June last week for RIR so if your attorney has not received any RFE by now he will receive transmittal notice (Case transfer from SESA to DOL) soon.

Attorney / Employer can call State office (not you) and ask about case status.

Thanks for all that information . If my case is transfered now to Fed , I calculate 16 more months as per today's procesing times.

Is there any chance of backlog reduction at CA Fed level ?

Of course PERM might do this .

I think ur current company must not withdraw ur labor if u need 1 year extensions beyound 6 years.
Perm is not there yet. We will hear about it some time this month. It seems DOL is likely to start accepting applications under perm from 1st OCT???. We have to wait and see what the rules look like. Assuming there are no major changes, u have to first advertize for 6 months or so in varous fora as specified. There is no harm in doing that. At the end of that period u can decide whether to file or allow the current one to continue.
