My 6th year starts in Feb 2009 and i work for company A. Company B is willing to process my GC under future employment category.
Any help on the below queries by an attorney/someone is much appreciated.
1) Should i have to be on the payroll of company B before the 6th year starts?
a) If so then, can i get my PERM filed now and move the company B once my I140 is cleared?
b) If not please, let me know my options.
2) When is the time-recapture typically done for a H1 visa - during the extension process/after the H1 period expires ?
