PERM Evaluation please comment

1. I am about to file labor under perm through my present company that has 12 employees only and is a typical indian consulting firm, with no direct clients but places people through mid clients.

*** Company being small, that could not produce the employee who could file under PERM is nothing but biased. Employee being less is not a problem at all. Dept of Labor doesn’t care if you have clients or you have to use mid-client to get a job intact. It all depends on how the sponsor company can provide you the salary, so if company is generating $$$, that it has an ability to pay would be good enough to file labor.

2. I am the only MBA in the company and my MBA is from an US university. Also, there are no project managers currently on the company's pay roll.
My current postion is that of Business Analyst.

*** When you have MS degree, you can file in as EB-2 category. Company can sponsor you as a business analyst or the project manager. PWD must fit your job requirement.

3. For my case following ad was published. Kindly comment on type of issues I may run into, if it qualifies for EB-2, if there is an audit what will they be looking into.

*** Recruitment steps should be followed closely to avoid the potential audit. When filing online, extra care must be given to avoid the unnecessary circumstances. Please read the PERM guideline carefully, so you won’t face any problem in the near future.
