PERM EB3 to I-140 EB2

I got my PERM based on EB3 and i'm currently applying for I-140 with EB2 checked? Is that possible and what is my degree of success?

I have a Masters Degree in CS + 5 yrs of experience.

Note: Reason we applied PERM on is EB3 because employer does not require Masters.

You have file as EB3. If the job requirement (opportunity) calls for Bachelors then it is EB3, if it also requires 5 years progressive work experience, then it is EB2 in othe words it goes with what job requirements calls, it doesnt matters if you have masters
Note i am not an attorney, do your own research, this is just an opinion

I have answered in another post - get another employer, get new PERM, get GC soon (if you are not from India or China) - get back to your current employer, if you like it. Or bitch and moan until they rewrite your job description to require MS.

Living as an indentured servant for 5+ years ain't worth ANY employement.
 
Where can we find the Current Priority Date for a SPECIFIC country other than China/India etc...?

On the Visa Bulletin they only list ALL OTHER.
