PERM EB2 advertisements before filing LC

hi all,

I am planning to file a PERM EB2 with a company who has not done green cards in a long time..so obviously they do not have a system of on going advertisements with SWA, Newspapers etc.

My question is, before they can file LC in PERM EB2, how long they should advertise? I know it has to be between 30-180 days but can they apply after say 60 days of advertising? or they have to wait 180 days? :confused:

I spoke to one of the lawfirms and they said I would have to wait 180 days before comapny can file LC. :(

NO. The Law firm is wrong.
180 days is the upper limit, that means any ad which was released 180 days before the filing date is invalid. The maximum duration between your first AD and filing date is 180 days and minimum duration is 30 days ( I am nort sure about the min. it is either 30 or 60 days).

You can very well file your case as soon as you complete your advertising and min wait period.

PERM rules state the last recruitment advertising should be done no later than 30 days prior to filing the application and no earlier than 180 days. So let's say, you get all your ads done by next Sunday, March 13. You will theoretically be able to file your PERM by April 13 .. provided you satisfy the other requirements of course (SWA job order, PWD, etc..).

Depending on your attorney, filing the PWD and placing the job order with the State workforce agency (SWA) should not take more than 1-2 weeks. The job order needs to be placed for 30 days. Concurrently, you'd want to do your pre-filing recruitment - newspaper ads, job site ad, company website ad, etc. 30 days after your last ad has run & after the job order has run for 30 days, you'll be ready to file your PERM application. Figure about 6-8 weeks if you start the process now.
