My employer applied for LC in 9/2002 as a systems analyst, EB-3. We got a NOF for Bona Fide Job. We are rebutting the NOF.

In the mean time we are filing 10th year extension for my H1B. I joind the company under OPT in 1998 as a programmer, later promoted to Systems Anlayst in 2001.

Now I am being offered Director of Technical Services position, which requires MS or BS and 5+ experience. I have a BS and MS from US schools. MS was paid for by the employer.

Is it good idea to file for PERM EB-2 with BS & 5 years progressive experience? I know all experience is with the current employer, but the job is different and higher.

Any thoughts and comments much appreciated.

Nof?

Hi,

What does NOF mean?

MS from US + 5 yrs exp. in PERM should be fine.

If you will be offered a director level position, and IF that can qualify under excutive category, you may skip the ALC step all together.
