Today I received pretty rough and bizzare news from attorney... Here are my specs

PERM Filed - July 18, 2005
Received Audit Letter - Dec. 09, 2005
Audit response Deadline: Jan 09, 2006
Sent Audit Response - Jan 05, 2006
DOL received audit response: Jan 06, 2006

After long try of few months my attorney was able to get hold of certifying officer. He said that my audit response was not logged in the system before 30 days deadline (even though it was received before 30 day deadline). That resulted in automatic denial in the system. They realize that it is their fault and have asked federal software contactors to get in the software code to fix the issue. He said it will take months to fix it and my case can not be reviewed till then. It has been almost 3 months since they received the response anyway and almost 9 months since the case was applied in the first place.
Does anybody have any advice or comment? Do you guys think the case will ever see light of the day or might get lost in DOL black hole as few cases did in older normal labor processing? My 6 year H1 will expire in August 2007. Do I have enough time to switch jobs and file again in time? Does anybody have any suggestions of future course of action for me.
Funniest part is my PERM status is still showing "In process" even though certifying officer said that his database is showing denial.
