Hi Guys,
I am from India and my PERM application was filed in July 2008 for EB2. DOL rejected the application in March 2009 citing Kellogg language was missing from my recruitment ad. My attorneys are saying that DOL has started to reject many cases on the basis of this requirement and basically this is wrong.
BALCA (appellate authority for PERM denials) has recently (Feb 2009 judgment) ruled that this type of denial is against the fundamental right and has awarded labor approval. As per my attorney, there is a 12-15 months wait for the appeals.
Is anybody is in the same boat? Please reply.
