Perm Denial Appeal and New perm fillng from same employer

My perm under EB2 category was denied on Nov 2010 after been in audit for 2 years...Now i have only 1.5 years left for my 6 year H1b limit....My employer says that he will file for an appeal for the perm denial and also a new perm with a different job title at the same time...Now my question is that can we file an Denial appeal and also new perm with a different job title at the same time from same employer....Is it safe to do so...Or is good to apply only for the new perm and doesnt file an appeal at all?It would be great if someone answer my above questions..Thanks in advance
 
The denial was lawyer's mistake..The salary offered was lower than the prevailing wage..Lawyer says that she will put an argument and appeal and also will apply for a new perm parallely..My only question is can we file both appeal and new perm from the same employer at same time.....Pls help me if any one knows the answer...
