PERM case withdrawal and consequences

We have decided to withdraw our PERM case. We are not alone.
Here is an interesting post from Murthy Forum.

"My PERM application was filed on 06/23. After a week it started showing “final review” and since past several weeks it is showing “in process”. Nobody has any clue when this case will be adjudicated. Mine was filed for EB2. My company got some approvals in 6/7 days recently whereas my application along with two more applications are pending since June 23rd. It seems DOL doesn’t follow any rule. It all based on some arbitrary human mood.

I went to one of the top Universities in USA and I personally feel that I am insulting my education and ethics by making me a subject of this stupid immigration process. I have told my employer to withdraw my case. I can not continue to go through this humiliation any more. I am contacting some employers in India and think I can get a very good job there before my return.

Those of you know Hindi there is an old proverb. “Apna angan tutahi sahi apna hai”, Your won courtyard will always be your own courtyard even it is in decrepit condition.

I am doing this not out of frustration but due to sheer humiliation that I can not face anymore. I came to this country as a student in 1992. Graduated in 1994 and worked here till 1996. By the end of 1996 I had to go back to India due to family emergency. Although I had a job here but I was offered a very good job in India and decided to stay back. I was very happy, no tension about status or immigration issue and the salary was just great. Again I came back to USA in early 2000. (Don’t know why I did this). My previous employer filed my labor in April 2001 and when they realized that it would take years, they again filed another labor under RIR in August 2001. Since then both the labor applications are pending. Meanwhile I had to change my job because my previous employer lost several million dollar deals due to economic slow down. My new employer again filed my labor on June 23rd this year. They followed everything as per the book and waited sixty days for recruitment process.

To DOL and as a matter of fact to all the agencies involved, we are just a file number not anything else. But we are humans and our hopes, aspirations, dreams, our careers, our family as well as our personal life all affected by this never ending saga of immigration process.

Enough is enough and I am not going to take this humiliation anymore. I have talked about this with my family and they all agree with me that a balanced and healthy life is more important than money or career. We can not cope with the stress and we need peace of mind.

I already informed my decision to my employer. They asked me to wait for just one more month. Meanwhile I sent my resume to one of the top placement consultants in India and they already lined up two interviews for me."
