Is there a need to petition the US-DOL and USCIS about the unfair procedures being followed with respect to backlogged labor certification cases versus new PERM cases? Retrogression in EB3 and EB2 categories is a reality and it seems wrong that the DOL is certifying cases through PERM without eliminating the backlog. Since the final aim is permanent residency, this policy of the DOL violates their FIFO policy: an applicant who filed LC through PERM three weeks back and got certified is now able to file I-140 and I-485 and might have the green card in hand by 2006. On the other hand, many LC applicants from 2001 might still be stuck in the backlog center and retrogression queues at that time. How is this a FIFO queue?
