I have labor in backlog from November 2003. My company applied new labor in Perm in July 2005 and lawyer typed incorrect SWA date May 2004 (instead of May 2005) and PERM got denied. This perm filing had my original date of Nov 2003.
My company again applied in PERM last week & filing date came as May 2006. It did not carry my original date (Nov 2003). When I asked about it, my company says we lost the Nov 2003 date in PERM.
My question is following.
If I continue with PERM May 2006 (currently in pending state) and if it's approved, will I be able to retain my Nov 2003 as Priority date?
Or should I withdraw my PERM application (May 2006) and continue with backlog center to retain my Nov 2003 priority date?
Any help will be appreciated.
