Chat User : What is the probability of rejection under PERM filing? Any statistics you have to share, or is it too early to comment on the PERM success rate?

Attorney Murthy : In the beginning, most PERM cases were rejected, not denied, based on errors in the software and other glitches. Now it appears that most cases are being approved. The Department of Labor has not released any nationwide statistics, but our sense, in communicating with lawyers around the U.S., is that these cases are being approved rather quickly; in fact, within about 15 to 30 days after being filed. This makes up for the many denials from earlier on and is faster than the anticipated 45 to 60 days, as the Department of Labor had advised. If the forms are filed correctly and all of the information matches, then the case should be approved. There is always a risk of a detailed audit, so the employer must retain detailed paperwork of having complied with the law to avoid a denial of a previously approved LC case under PERM.
