Six years of my H1B expires on Nov 2010. Company A filed for my PERM in March 2008, which is still pending. I have already received 1 year extension, when I started working for Company B, based on previous PERM and recapturing of the time outside US, which sets my H1B expiration to Feb 2012. I am planning to join Company C.
1) Is it possible for Company C to file for PERM in July 2010 (which is really the 6th year considering the original H1B expiration date as Nov 2010) and be able to get approved before the new expiration date (expiration date after 1 year extension and recapture time, which is Feb 2012)? Can I get H1B extensions based on the approved PERM thereafter?
2) Are there any repercussions on PERM from Company A getting denied or approved while Company C is applying for the new PERM?
Thank you very much.
