PERM and Pending Non RIR LC???

Can Non RIR labor applications pending with State SWA's for e.g. Texas SESA (Enterject) be withdrawn and converted to PERM labor application by completing the recruitment efforts and filing new labor within 210 days and asking to retain the priority date??

Any comments on this option...
 
Nobody knows yet. You need to wait a week or two for the attorneys to get back from vacation and post some analysis of PERM.

12/23/2004: PERM Final Regulation Loosen Up Requirements (PERM Series 1)

Conversion of regular labor certification application to the new PERM application will not be available once the employer commenced recruitment process (job order) under the supervision of the state labor department.

So I guess it is possible if recruitment/ad process has not commenced.

My labor was filed in NY state on July 2003. And New york
is processing April 2001. Does this mean that my
recruitment process has commenced ?

Help will be highly appreciated...what is Job order by the way
