PERM Advertisement

Hi Friends,

I have 14 months on my h1. My company started avertisements for PERM labour lastweek. Will they able to apply my perm before my 5th year started.

How many months of avertisement required bofore PERM apply.

What kinds are avertisements they have to do, is there any flexibility

because i have only 2 months to reach my 5th year.

Can you please any body suggest me to proceed futher.

1 month AD. But need to subscribe your job to SWA, it could take some extra days since SWA could delay the post and notify (they are so busy with a lot of PERM). So, you need 1+ month for ad.
1 month cooling off period.

So, total are 2+ months. That assume that you could get the PWD from SWA during that period and the ad. you post with the salary higher or equal with that PWD (which you don't know). But attorney could guess based on previous PWD from other people that have similar case like you. (worst case, if the posted salary is lower than PWD. You might start over).

Then the next steps are applying. I assume your HR and attorney NOT DOING ANYTHING ELSE except to file PERM for you. Then you could get it filed in a week. IF NOT, count another month.

That is why I usually say the total prepare day for PERM is around 3 months.

For the Ad., ask attorney before doing so. You don't want to wait until everything done then found out missing something.

3 Options for you if you CAN NOT apply PERM before 365 days from the 6th year.

1) GO HOME or marry US citizen But that is the worst option.
2) Try to capture days you are not in the US during your H1B.
3) Pray you can apply I485 when PERM is approved. You or your wife MUST from the rest of the world and PERM is filed in EB2.
