PERM -- AD Options

After waiting for LC for about 4 yrs, my company finally agreed to file PERM. We are in the initial stages and I would like to ask Gurus for some clarifications:

- I have a Master's Degree in Computer Science, and would like to have my PERM application to be considered for EB2, so in the AD do we need to specify the Min. Education and Experience requirements. The Ad sample that the lawyer has prepared has job descritpion, location (NY), name of the company etc. but no mention on min. education.

Is this ok, or should I insist that the ad has these requirements.

- The second question is actually looking for an advice on where to place the Ads, The ads will appear in 2 consecutive Sundays, and the newspaper online section, Place a job order with Americas Job Bank, an on our company web site where we normally jobs displayed.

The lawyer is recommending for another place thru which we would carry recruitment effor, like hire a company of head hunters etc, My company is not so thrilled about doing this. So Is there any web site on which we can place ad that will fulfill this requirement. The area of course is software engineering.

Any advise will be highly appreciated.

AJB satisfies the requirement for online advertisement. That is made clear by DOL. Why do you need any other online recruitment option?
 
This is based on the lawyers recommendation. What he is recommending that we use a trade or professional association to conduct recruitment effort. This association could have a publication or an online web where they post jobs.

So to enumerate the recruitment effort would consist of:

1. 2 ads in consecutive Sunday newspaper and their online section.
2. AJB
3. On our company Web site. Our companmy has a career development site where jobs can be posted.
4. Notice of filing,. (Inhouse notice board)
5 and, contract a trade or professional association.

According to the lawyer for option 5 we need contract with the company and paper work as proof that the effort ws conducted.

Is this an overkill?

You would need to use any 3 out of following 10 options
* Job fairs;
* Empoyer's website;
* Job search website other than the employer's;
* On-campus recruiting;
* Trade or professional organizations/publications;
* Private employment firms;
* Employee referral programs with incentives;
* Campus placement offices
* Local and ethnic newspapers
* Radio and television advertisements.

The third option your lawyer is going for is "Private Employment firms" and is needed if no other third option is suitable. I'll suggest to look into "Employee referral programs with incentives" as it is the easiest third option.

I was researching on the web and came across this Web Site: http://www.nysia.com/.

This web site is of the New York Software Industry Associates and they have a section on the web site on which jobs postings can be made (Costs $75 to posts ads for non-members of the associations).

We checked with our Lawyers and they are ok with this web site as the other 3rd option.

Can you also comment on my other question, which was that the ad must specify the min. education requirement (MS in my case), to be considered as EB2 when we finally file PERM, or is it possible to specify min. education as MS in the form 9089 and have no mention of the education requirement in the ad.

Advertisement can be placed broadly with few details regarding job duties and requirements. However, the employer must prepare a recruitment report that addresses all minimally qualified applicants for the job opportunity.

If you placed a generic advertisement, the employer have include all received applicants in the recruitment report.
