New Employer & 7th Year extension???
My 6 yrs on H1-B visa is expiring in Jun 2006 & I applied for GC under old process in Dec'04. Since with PERM processing Labor clearance is faster:
1.) Can I change the employer now & file for a new GC application under PERM processing (say 6 months before H1-B visa expiry) & still be eligible to file for H1-B extension after 6yrs?
2.) Is there any way I can switch to the new employer, apply for the GC & stay in the US after 6 yrs of H1-B visa expiry, legally?
3.) I was told that I can join the new employer provided, my existing employer continues the Labor Certification process & files for I-140 for me (jnspite of me working for another employer). After that, I can process the I-485 with the new employer.
Can anyone verify? What are the risk?
