Period of H1+F1

Friends,
My situation is as follows

1. I have been in US from may 1998 on H1.I was in india for 3 months and 3 more months again.I was in singapore for 4 months.Does this period counts for the 6 years period.
2. If I get F1 (from H1), does my H1 6 period resets or F1 period also counts for the 6 yrs period
3. Suppose F1 period is not counted , then if i get new H1 ( i have to go outside US for stamping),is that like new 6 yrs period or its the continuation of the old 6 yrs period..
4. Is it manadatory that after our H1 6 yrs period is completed, we shouldnt stay in US for one yr even we want to be on F1 or on a new H1 or H4 or if we marry Green card holder

H1b to H4 transfer

Hi,

I am working In USA on H1-b Visa. My Wife is also working here on H1-b. I have been asked to leave by March - end. What is the procedure to file for H4. What docs I need to submit, How much fees I need to submit, and Where I need to post all these docs. How much time it will take to get H4 Visa.

H1 VISA EXPIRING ON MAY 31ST - SOME CLARIFICATION PLEASE

All,

My H1 expires on May 30th. My LC is already in the Texas center for over a year (both Regular & RIR) . Can someone answer the follwoing:

1) Can I get extension for the numbe of days I was out of USA during my total 6 years of H1 time?

2)Since my LC is pending over 365 days , is it possible for me to get 7th year extension?

You have to change your Status from H1B to H4
1. you need to fill up form I-539
 you need to sumbit copy of your Wife H1B approval,her Passport pages with valid H1B visa and copy of her and your Valid I-94( copy the both sides of I-94)
 Froff of your Current Status like your pages of Passport and Stamp of H1B visa on it.
I think the Fees is $120( but recently INs has changed the fees) go to: www.immihelp.com or www. immigration-law.com and find the correct fees.
 you have also to submit the copy of merriage certificate. Better provide a letter how you will survive, just write that your wife Hema Malini is working with Subash Ghai on H1b visa, provide the letter from her company or attach the copy of her recent PayStubs.

You should file it to service centre for NJ,NY MD, CT,PH is VSC for other areas are diffrent 3 Service centres. you can find about the address of service centres on :www.immigration.com

 You should file for H1B to H4 status change before your H1B is cancelled or you are layed of.
 When you send the Papers to INS service centre they will send you reciept in 15-20 days, once you have that reciept you are fine becaue to send your H4 approval they may take 3-4 months, once you have reciept you will be fine, once you get the approval( it will be given till the date your wife has approved H1B visa stamp) then you can revalidate your h4 visa in US or when you go to your home you can get H4 Visa Stamp, but you can stay in US with H4 approval notice and you will get new I-94 with your H4 approval.

They Lawyers do not charge much for this kind of filing if you have good lawyer just pay 100$(+INS FEES) he will file for your status change.
If you can find a new employer then you can transfer H1B.

1) YES, many have done this
2 I do not know becase some other friend should let you know, because many say after 365 days if LC is is not still approved YOU CAN get it, some say LC cleared and one should have filed for I-140.
you can also contact a good lawyer and seek the legal advise
