Per CSC: On concurrent processing of 140 and 485....

Pls see this e-mail exchange between me and CSC when I asked them about why my 140 has not been touched yet. They had sais they will wait till FBI name check clearance. Can anyone make sense out of what they are saying????

The EB2 petition was part of a pilot program. The program was for (EB2) I-140's that have been filed as concurrent filing along with the I-485. The Service wanted to see how long it would take for the entire process to be completed. At this time the pilot program has been completed but we are still tracking all the petitions involved in this pilot program.

Having the I-140 in a pending status does not affect the adjustment of status due to the fact the applicant is adjusting in the United States. As soon as the FBI name check clears, both application will be processed.

This pilot program was ONLY done on EB2 classifications.

I have seen many applications where the I-140 has been approved even while the I-485 has been pending in name check. How is that possible?

The I-140 will be adjudicated once the I-485 clears fbi name check. Both applications will be processed at the same time.

The Service has NO control over how long it takes FBI to clear the name check..

I don't really understand the correlation between your question and the response. Were you able to clarify this with your attorney ?

I believe they have not understood my question......I have contacted my attorney...but he is even slower than CSC in responding...

I did not see much correlation between the questions and answers either. However, since INS answer the question this way, I have a reason to assume that the EB2 catergory applicants will be still in the so called "pilot program", which had advantage over other categories before and has no advantage anymore now, since CIS has signaficantly reduce the processing time for all categories. I heard that some EB2 applicants in pilot program had to wait for FBI name check, I would reasonably think the INS GAVE more cautiousness to the pilot program because it's processed fast and NEW as a PILOT program.
In short, EB2 applicants might have slightly more chances to be picked to do the stupid name check. However, the real factor is: if you have a unique name or fairly long name, the check will end soon. ( My friends- a couple, called in to check their status, one was told all set, the other was told "waiting for the FBI name check". The couple have different fist names and last names. The one who's waiting has short and very common names.)
 
It's not true that only some people will be "PICKED" for Name check. Everyone needs to clear the Name Check before their case could be approved. You could be right about the people with long and/or unique names clear name check faster. The problem is the process/communication between USCIS and FBI is not very reliable and few people end up in deadlock situation.

Any Idea , how much time does Name Check Process take to complete. I have heard stories where people have waitied for years for there name check. Is that exception or norm?
