People with Incorrect/Misplaced/Lost Labor Approval Notice filing for I140

Hello,

My lawyer received the approval confirmation today. Looks like the DOL has sent the approval notice of someone else with the confirmation.

Has someone else faced similar situation?

The lawyer has requested a duplicate copy of the approval notice. However the notice will directly go to the CIS in conjunction with the I-140 petition filing. What could be the consequence of all this?

Here's some information that I found, in case someone else is in the same boat (incorrect/misplaced/lost labor approval notice).

Hi Garg,
I have a similar situation.
I received the approval letter.
However my attorney has not received it and he has not received the ETA 750 A and B.
Which means we can file I-140 but with a letter requesting USCIS to ask DOL for the Original copy.
Also - I guess you cannot file I485 concurrently even if ur priority date is current (as in my case).
 
Hi, just wanted to post my case details if it helps. Can you both please let me know what were the timeframes involved in your case? My story below:

We never received my approved Labor cert but still we filed the I140/485 concurrently around Nov 1st 2005 with a letter stating that we never received the labor cert from DOL. They rejected the whole case (i guess they didnt see the letter buried int he paperwork) for lack of labor cert. We filed again on Dec1st this time with that letter as the first page of the filing. The case was accepted (at VSC). The letter did not request the VSC center to ask DOL for a duplicate copy. In any case I got an RFE in Jun/Jul timeframe asking for company financials, exp letter and labor cert. I changed my lawyer to an experienced lawyer and she filed the RFE response in JUl end and along with other things clearly asked the VSC to request DOL for duplicate labor.

VSC then sent a letter to DOL ( it took us about 5 months to find out the status on this) and we requested a copy of that letter. We finally got a copy of letter sent to DOL in March 2006 and to our horror found that VSC requested from DOL using my case number but only that they had a typo in the case number. We rushed to correct the VSC to update the letter that they sent withthe correct case number. This was the last status as of April 1 2006. Hopefully no one ever goes through this hell.
 
I140 Approved

My I140 got approved yesterday (07/27/06). The lawyer sent the application on 07/11/06. Don't know when USCIS received it though..

No RFE was issued. I am hoping this time my lawyer will receive the correct appoval notice...
