Pending since 2002, Security Check, Contacted Congressman Office, suggessions.

NSC, EB2, RIR , India, PD 05/2001
140 AD: 11/2002. ( Included Wife in 140)
485 RD: 11/2002.
FP 1 : Jun2003.
RFP : Aug 2004, INS Rec. AUG 2004 ( Photos for both me and wife)
FP 2 : Nov2004.
FP 3 (Code2) : May 2005
AR 11 : March 2005.

Did Inquiry on March 2005 at the time of AR-11 and get response back telling that
"Current processing date is ....your case is 11/2002.. blah..blah".

My Lawyer did another Inquiry on May 2005
"Due to Pending caseload and Security.... blah..blah".

Same time (may 2005) contacted Congressman office and explained the situation
They called in front of me and got response back " Case is waiting for Security check response". My wife security check is cleared.

Also they told that they will contact again and get back.

Yesterday , i got a letter from Congressman Office as follows.

" The FBI has contacted my office regarding your concerns.

I have learned that your background check is still pending as of March 7 2003. They suggested that i Follow-up with them in 90 days for an update.

As soon as i gere something more, i will be sure to let you know. "


Here are my doubts.
1) Does FBI people Contacted Congressman Office ?

2) My First FP is on Jun 2003, Then why it's waiting from March 7th 2003 ?

3) Is Security check is after FP process ?
so, 2nd FP also go through the same ?

4) After Security check does it goes to Officer ? Then how got RFE on Aug 2004 ?

5) How long background check will take ?

6) What are they looking in background check ?

7) I am Planning to visit India on July last week and return in Sep 1st week.
I got Emergency AP in April, but postponed the trip to July.
Does this effect to my trip or GC ? ( AP issued in Chicago)

I think our cases are quite similar
my 485 RD is 11/13/2002


i contacted 2 congressmen and 2 senators. Both senators appeared to be completely useless. The only information i got from one of them was that my name check was initiated on 12/29/2002. Otherwise it was just replays like yours - this case pending waiting for name check.

My first FP was in february 2003, so i don't think name check and FP are closely connected.
My 2nd FP was in February 2005, and name check was still pending since december 2002.

One congressman gave just another piece of information: that my case was transfered to local FBI and was sitting there for 2 years, but by that time went back to Washington DC FBI and now is sitting there.

Another congressman was much more helpful. His office bugged FBI every 2 weeks for 4 months, and finaly i got letter from him that my name check was completed on 6/23/2005.

I hope I won't stuck in name check for as long as you did.

I asked for help from a congressman but his office didn't contact FBI but contacted USCIS instead.

How did you get ahold of the local congressman? Did you call his office or write?

I went to congressman office. A good friend of the office manager came with me. And he personally asked his friend to help.
In response to phone calls, mails, and emails I got only usual crap: your case is pending.
