Hi,

i entered the usa with a b1-b2 visa. I married the father of my 2 american children who is an american citizen. We filed form i 180 first (which is still pending) and then we filed for i 485 with the employment authorization. We got a pink letter 4rm uscis requesting more evidence because my husband does not meet the income requirements for our household, or to look for a joint sponsor.

What are the requirements to get a sponsor? How much does that sponsor has to make? The sponsor income has to be accordingly to his household # also? Also, if my i485 is denied what happens to my b1-b2 visa? Do i need to apply for a new one in my hom country? Or my visa is still valid and i can travel back next year or so? For how long am i allowed to stay here? Im really confused since we have so little time (about 45 days- april 4th)

Download and read I-864P and the I-864.

Your B1/B2 visa is already dead because of your overstay. You will need a green card to exit and reenter the US. Or Advance Parole, if your overstay was less than 180 days.

Exiting the US could result in a ban from entry. Based on your question which is quite basic, it is in your best interest to consult an attorney for assistance. Social service agencies offer assistance with immigration issues to low income individuals. Look for Catholic Charities and Lutheran Refugee agencies in your area.
