Hi :

My I-140 is approved under EB1-EA category (self petitioned). My I-485 is pending for more than 450 days at NSC. Right now, I have my H-1B till May, 2003 (same as I-94) and also have my EAD till Feb, 2003. My questions are : In this situation, for any reason, if I get laid off,

  1) Will there be any adverse effect on my I-485 approval ?

  2) Since EB1-EA category does not require a job offer, do I still need to have a job for my I-485 approval ? and

 3) In case I loose my job, will I be considered out of status, then ?

Thanks in advance.

     Don\'t understand this Q.
2) Since EB1-EA category does not require a job offer, do I still need to have a job for my I-485 approval?
Did you submit an employment letter, payment tubs, or W-2 with your i-485? If so, you don\'t need a job for your i-485 approval.
3) In case I loose my job, will I be considered out of status, then ?
If you loose your job (H1b visa is gone), your status is AOS (not out of status). Not so sure about this.

By the way, are you using your EAD for a second job?

Hi :

Thanks for your reply. I did submit everything together with my I-485 package, including employment letter, payment stubs, w-2 forms for last four yrs, etc. Even I submitted another employment letter with my finger print yellow form in March 2001.

Right now, I am still with my present compnay on H1-B1. I have EAD, but didn\'t use it yet. I am planning to use it if I change job now.
