I'm very new to this forum. I've read some of the posting to get some idea as to what other people in my situation are going through but mine seems to be unique. Therefore I decided to register and post my situation. Any insight will be greatly appreciated and thank you in advance!
Note: Since I'm new, I won't be able to use abbreviations as you all seem to use. Sorry about that. But I'll do my best.
-Married to USC
-D.O: Charlotte, NC
-Initially came here with F-1 visa
-Never overstayed my visa technically
-Lapsed my studies in university for about 1.5 years (on and off)
Now, here is how I differ from everyone else here:
I got married on July 18, 2003. AND I HAVE NOT EVEN BOTHERED TO APPLY FOR GC as soon as I got married. It was always at the back of my mind that I needed to apply but as time went on, I forgot about it or didn't even have the money to even apply for GC. So this went on for about 16 months until one day USCIS officers knocked on my door to apprehend me @ 6:00am in the morning.
Long story short, I was in jail & immigration detention center for 19 days (7 days in Charlotte, NC and 8 days in Louisiana).
As soon as I was apprehended, my wife hired an attorney and upon spending a ton of borrowed money, I was released from jail.
Since I could actually write a book about this whole incident, I want to keep it short and precise.
What I'm wondering is the following:
Right after I was released from jail, a deportation case was opened in Atlanta, GA court, which was dropped sometime in 2nd quarter of 2006. As of now I'm no longer in deportation jeopardy since I won this case.
I got my I-130 approval (which was a regular interview) on August of 2005. Normally everyone would send in their applications all at once but since I was in deportation status, I was only allowed to go one step at a time. Not to mention I would have to wait for judge to tell me when to apply for the next step. Upon I-130's approval, it took the court 8 months to tell me to apply for I-485 and I-765. In April of 2006, I applied for both. Receipt date for I-485 was on April 14, 2006. Don't even ask about I-765 because it got lost in the system and I had to apply second time and finally got it a month ago. I'm not even happy that my freaking work permit is here because I've lost a great job a month prior which I can no longer have access to since I'm a 3D artist and there is only 2 companies in the whole city related to 3D. I'm also done with finger printing, both for I-485 and I-765. LUD on the website shows inactivity for 7 months now. What shall I do?
Also, I cannot benefit from case processing dates posted by USCIS because I was instructed to send in my I-485 to Texas Processing Center. And whenever I look at TSC's dates, I don't see family based I-485. I've found out that TSC doesn't even handle family based I-485. The only reason I was told to send my I-485 there was the fact that I was in deportation status.
In short, I'm desperate. I don't have a single clue as to what's going on. Please help!
