Pending GC and J1

My LC recently got approved (PD Feb 2004, EB2) and I am in the process of filing the I-140. With Premium processing now available for EB2 140, I am hoping to get my 140 approved within a month. My wife is part of my application. She is applying to residency programs across the US. I am wondering if she should consider accepting a J-1 visa. We are hoping to have our EAD within a year from now. Will she be able to take advantage of the EAD and the subsequent GC and get off the J-1 visa, without going through the rigors of J-1 waiver etc.

Thanks.

Hell No !

Once she has the J1, she won't be able to get a GC along with you. She will be blocked from getting a GC from 6-10 years. There is no getting 'off' a J1, the only way out of J1 prison is a waiver.

She should either find a residency program that sponsors H1b, or she should wait until the EADs are through and do the residency as an immigrant. Having the EAD will increase her options for residencies.
