Pending GC and 2nd marriage...

Hi...
i have one question if somebody knows about it....if ur green card is pending....married with USC and applied GC...is it possible u divorce her and marry with anyother USC and applied for gc again...?? or u cant do it..?

Dont want to scare you, but if i was the immigration officer, i would regard this case with high suspicion and send it for field investigation and would also make sure that the interview is hard enough so you crack up if you came in with intentions of commiting immigration fraud.

My best advise is you to get a good lawyer. Your I-485 is still pending? For how long have you been married? Thos are very important things. As I said get a good lawyer.

Ari is right. They will consider it as a fraud and no matter how much supporting evidence you’ll bring to your interview with your second wife, you might and probably will get in trouble.

My first impulse was to tell you to withdraw your current petition now, before INS has a chance to look at it and call you and your current wife on the interview. Then later, when you all settled and remarried – file new I-485 and be ready to answer all the wicked questions you will be, undoubtedly, asked at your interview.... But then I checked your profile….…. and looks like you already went to one unsuccessful interview and now they ask for more evidence. You also admitted (on this forum, not to INS) having marital problems and thinking of divorce (among other alternatives).
In your current satiation, no matter how bad it looks, you better stick with your current case, get more evidence and go for that second interview. Of course you have to have one understanding lady to help you with this… and one good immigration attorney!

I am agree with Ari too. Sorry boy. I mean, even with the withdrawal, is not that they won't look at your past case, because remember you will have to put if you were married before and if you applied for permanent resident and all that will be yes in capital letters.
