Pending Case

Hi there,

I had my test in the Dallas Service Center on August 12, 2003. Until today (December 1, 2003.) I have not yet received an answer. After I took my test I received a paper indicating B.) A decision can not yet be made about your application. Along with a letter stating:

"We are unable to approve your application at this time. To ensure our national security additional background checks were institued to ensure all applicants qualify for the benifits sought. A review of your file revealed that your name has not cleared the required background checks. This office constantly monitors the progress of the required checks and has instituted new procedures to insure that all applicants are completed in a timely manner. Unfortunately, these checks are performed by another agency outside the BCIS and we are unable to predict when your case will be approved. With the limited amount of resources available we ask you not submit an inquiry on the status of your case for at least 6 months."

Does anyone have this same situation as me? And can anyone tell me how I can find out about the status of my case and how long it can possibly take?

LOL we are all drowning here and just grabbing on to one another for survival...hahahahah take care.

i would say Dallas office was nice enough to give u that information because thats exactly whats going on thesedays. they were nice to let u know how long u might wait and what the circumstances are, because here in NY no one tells applicant after interview about the wait they might do.

for example Take my case, i was interviewed in NY office in first week of july 2003. and i had paper which said congratulation ur application is recommended for approval and i am still waiting 5 months have passed. It would be nice if i had same piece of paper which u got , because then i wont worry about putting inquiry on my case for 3 times, and no reply from BCIS from those inquiries, that was total waste.

and i dont know how long wait is ahead of me. i think three more months. maybe more.......................

The Dallas office is very slow and there have been many people waiting more than 6 mo after interview to receive an Oath letter. My interview was on Feb 20. I received the paper stating
A) Congratulations! Your application has been recommended for approval. At this time, it appears that you have established your eligibility for naturalization. If final approval is granted, you will be notified when and where to report for the Oath Ceremony.

As of today I am still waiting for their decision. At the end of June I sent a registered letter to the local INS district requesting the status of my application. Never received reply. A month later(end of July) I called the national 1-800 line. They told me that the reasons for the delay are within the local office. At that time it took an year from filing N-400 to oath for the Dallas area according to the lady handling my phone call. She forwarded my inquiry to the local INS office. Around August 20 I received a letter from the local INS office stating "The status of your claim is: Your case is currently pending schedule for an Oath Ceremony". As of early October I still didn't have any Oath letter from them. So I went to 2 local congressmans. The first office refused to handle the case because I wasn't in their district. On October 8 I went to the congressman in which district I reside. They took my package (letter explaining my situation, copies of Notice of Action, interview results and inquiry letter) and told me that they will contact the INS. They also stated that they will have a response after ~ 30 days. Needless to say they have been not helpfull. I contacted them around 10 days ago. They still didn't have a response from the INS. Now the lady told me that "the INS doesn't reply to us many times. The most I can do is e-mail them. Wait". I was shocked with her answer. E-mail, folks! I thought that they will make a phone call or sent an official letter. No wonder she never got a reply if she e-mailed them the first time too. At the moment I am preparing a second letter and plan to contact my senator's office and see what happens this time. I hope they to be more helpful than my congressman's office in resolving this situation. It is extremly frustrating.

Here and on other boards have been discussians with some of the members feeling that the delays are because of the new security rules(i.e. being young male, problematic country of origin, etc requiring more background checks). I doubt that this is the reason in all cases. I am a female, not a muslim, not from a problematic country, did not request a name change, never had even a traffic ticket, green card holder for 10 years, married to the same guy (American citizen by birth) for more than 10 years and am still caught in the red tape.

i also contacted my senators office , i live in NY nassau county and congresswoman in my area didnt even show any interest in my problem and told me WAIT with out even doing anything.the way she talked to me i felt like i am some trouble maker and bad guy and probably on FBI's watch list who is trying to hide under her table by asking her help. ( whatttttttttttttttttttttt)

and senators office,,senators office told me to relax and wait since there are ppl who are waiting for 15 months and 20 months after interview and i am no special since its ONLY been 5 months after my interview.... I told her there are those ppl as well in NY who get oath letter in one month, why cant be I one of those who got oath letter in timely fashion instead of one of those who been waiting for 20 months???????,,, they took my case and told me to not to call them back until 11 weeks pass. yes 11 weeks, thats the time frame senator's office gave me , and i assume there is not much help either.

I REGRET APPLYING FROM NEW YORK STATE.

and not that i talked to them in any frustrating way or upset temper. i even kept smiling on the phone while i talked to them but no positive avail.
