Hi,

I am thinking of changing job very soon. Actually I have received an offer. So please help I have to make a decision whether I should accept.

I am currently working at a small company on grant-related projects. My field is biomedical optics for cancer detection. My job title is staff scientist. I just found a postdoctoral position in a famous hospital working on cancer irradiation treatment The temprory postdoc training could offer me much much better career future, in terms of salary and benefits. So I would like to make temporary scrifice.

Now comes to my case. I filed 140 by myself through NIW in Aug, 2005;485 in Sept, 2005. Based on the the previous posts, the information I got is that I have to wait till the 485 is pending for more than 180 days. Is it correct? Also before 140 is approved, i have to keep in the same field. I am not sure whether my case is in the same category or not. Please help.

Thanks,
MM

You are free to change jobs as long as you're in the same field for which applied for NIW.

From industry to academics, from staff scientist to postdoc (with salary cut?), from diagnostics to treatment... I think this looks complicated and might be viewed suspicious by uscis. It may be best to consult with legal professionals, like your own, or the one from your prospective employer. They do have to work on your visa case anyway, if they are going to hire you, right?
