The people who said it may move in the other direction are saying it based on the postings in murthy.com and i guess shusterman.com (which quoted DOS officials saying of such a possibility. But, DOS had also stated earlier that they will move dates cautiously and try to avoid a situation where the dates have to go back.). (See below for links)
This immigration process is being overhauled and we are in a state of flux.
- Steps are being taken to expedite backlog reduction. Although, we are not yet seeing the flood of backlog application approvals, it might happen anytime in the near future.
- If they stop labor substitution, it may help further. (Personally, I think, they should allow labor substitution within 45 days or so but should have the priority date as the date of I140 application for such cases instead of the labor date).
- We don't know the category breakdown of applications in BECs. (Schedule A
applicants dont need labor so the recapture of 50000 does not help much here). If this information was available publicly, then we could atleast take a calculated guess at how the PDs might move.
- We are seeing consistent approvals of I1485s.
- Bush wants to reduce I485 time to 6 months.
- If it becomes a huge mess, new bills might be introduced to alleviate this problem. These people are usually reactive than being pro-active.

* FB: Overall one month or less progressed but no retrogression.
* EB: EB-3 remains same, but EB-3EW (unskilled worker) retrogressed more than two years from 07/01/01 to 01/01/99.
* VISA AVAILABILITY DURING THE REMAINDER OF FY-2005
Employment-based: During the past month there has been a significant increase in the amount of numbers being used by Citizenship and Immigration Service (CIS) offices for adjustment of status applicants. This level of demand has significantly depleted the supply of Employment-based numbers available under the annual limit. Recent discussions with CIS have made it clear that their backlog reduction efforts will sustain or increase the current level of demand. Therefore, continued visa availability in the Employment-based categories cannot be guaranteed during the final quarter of FY-2005. If demand continues at the current rate, it will be necessary to oversubscribe many or all of the Employment categories on a Worldwide basis. Such oversubscription could result in the establishment of cut-off dates, retrogression of already established dates, or some categories becoming “unavailable”.

Future Projections of EB3 Retrogressions
For the remainder of FY2005, the DOS expects the EB3 numbers not to move much in either one direction or the other. EB1 and EB2 are not expected to retrogress during FY2005, which ends September 30, 2005.
