PD retrogress making one\'s PD "not current " will lead to further wait
One however can continue extending the EAD till infinity...till the PD becomes current and the I485 can be approved.You can find it in murthy.com and many other sites.
It is true and no romour. PD plays a pivotal role both when applying and at approval stage. When they begin to work on your papers and at that time if your PD is not current they just wont look at your papers period. Hope this helps
Hi It is not rumor. This is the fact.
Let me explain here:
The person "x"\'s PD is sept 2001. He is ready to file I-485.
(i.e. his labor and 140 approved). He has to check whether his
dates are current or not. If the dates are current then he can
file his 485. Before his 485 approved, if the dates retrogressed
(It happened in the past) his application has to wait until
his dates become current again.
Many times the INS picks up their application and they see their
dates are not current at that time they send a letter saying that
it is denied. It happened to many of our friends out there.
Some good guys at INS go through details and see that their
dates are retrogressed and put the files back onto selves.
When the dates become current then they will pickup those
applications and take the action on it.
My attorney says PD retrogressing does not matter after AOS is filed
I have a I-140 cleared for CP and going for AOS.
I asked this question to my corporate attorney - and my attorney confirmed that once the AOS is filed and PD retrogresses, it will not affect my application.
