My friend submitted an application to DOL in 01-2001 (EB-3 skilled worker). Everything was fine until the interview when the immigration officer found out that my friend's sponsor had problems with taxes. The application for GC was denied. He was told he could apply for a GC once again as he is 'covered' by 245(i).
My understanding is that he has to get a labor cerification form DOL once again. Is the priority date 01-2001 or the PD will be 2006?
