Hello,

If the PD for EB3 becomes current. Do we need to notify INS, That my PD is current, Please process my 1-485.

Dude -- you don't have to do anything .... you just have to hope they'll realize the deal about PDs !!

BTW, if your PD is May 2002, its already past the cutoff for EB3 (which is processing PD <= 1 June 2002) -- so your case should be eligible now.

1. I think my question is funny. What i mean is i applied 1485 in Aug 2003. Just know i have seen EB3 PD date is June 2002. My PD is May 2002. My question is since i already applied 1-485 when it was current. Do i or my lawyer need to notify INS that my PD is avaliable.


2. Is there any draw back in sending FBI email regarding name check. Will that be a problem.

Sorry -- didn't mean to make fun of your question or something .... I guess me & serta didn't quite understand if you were being sarcastic or not !!

(1) I don't think you can do anything. NSC is "officially" processing Jan 2003 ND cases -- so even if you send an enquiry, you'll get a lame a$$ response that your case is not "ready" yet.

(2) No adverse effects by emailing FBI -- I think they take their own sweet time to respond -- last I heard it was taking more than 4 months for a response !!
 
My intention was not to make fun of you. As max pointed out, I was not sure whther you were being sarcastic.

My timelines are quite similar to yours. PD 03/2002 and I-485 applied in Aug 2003.

Coming back to your original question there is no point in 'notifying CIS that your PD is current', because your (and mine) I-485 notice dates are for Aug 2003, whereas the official processing dates are Jan 2003. So the stanadard reply from USCIS will be 'you need to wait till the processing dates are 30 days past your I-485 ND'.

Bottomline, is we need to wait until processing dates are atleast 30 days past our ND before we can even ask CIS whats with our case ? :( !
