Is it possible to use Priority date of the labor filled by current employer and EB catagory of Future employer LABOR and never work for future employer.
I filled three Labor from three different companies including my current employer other two are Future employement basis, all three Labor are approved. Labor thru Current employer has Priority date of early 2002 but it is EB3 and I can't file I-485. Other two Labor are EB2 with PD of Aug 2004.
I know people move to new employer and use Priority date from Previous employer after both I-140 are approved. I have a different situation I don't want to change employer, I want to use Priority date from the Labor which is tru my current employer but want to use EB catagory of the future employer's Labor so that I can file for 485. Is it possible to file I-485 with Future employer and use PD from current employer and still working for current employer and After 180 days notify USCIS for my intention not to work for future employer but to continue working with my current employer.
I think this is not right do you think USCIS will deny case without even looking at it. What is the rule? Shoud I take a risk or wait for few more years for EB3 PD to move to Feb 2002?
