Chat User : I-140 approved for CP. What is the procedure for canceling CP and applying for AOS with I-485?

Attorney Murthy : Actually, one can go ahead and file the AOS paperwork. Then notify the NVC and the consulate to return the file from the consulate / NVC back to the INS Service Center to avoid delays when the INS completes review of the case but cannot approve it since the file was transferred to the consulate.

I didn\'t understand exactly what is your question!

If it is "Can some one cancel CP and file for I-485?" the answer is Yes, and you have answer from a prominent attorney who knows far more better than I do. Also, yes, I heard that couple of people on this board who considered this option.

If your question was "why would some one do this? If CP is approved then why don\'t they directly go get it stamped and come back! Why wait for another 6 months for I-485?" then the answer is Yes, in some cases it is safer to go for I-485 compared to CP. There could be several reasons.. If because of any reason GC is not given then the person cannot travel back to US! Problems may arise because some one is out of status, layoffs, no paystubs, one cannot use AC21 portability rule etc. All these things are discussed in several threads on this board which talk about "CP vs I-485".

I have in same situation, My I140 approved for CP, but I have applied for AOS. I don’t think my lawyer informed NVC about my AOS.

Should I ask my lawyer to cancel CP? Can any one let me know what are the steps?

I spoke to NVC 2 mints back..they said there is NO need to inform us or consulate in India.Just go ahead with ur AOS..he said INS has a copy of our whole file...he said ur fine..

I think Murhy is NOT giving replies directly..may be her paralegals r in that Chat...its misleading info..

i read somewhere

that attorney generally file I-140 with option for cp
and when I-140 is approved it says approved for cp
when u go to attorney\'s office for filing I-485 he explains both the options and asks u to decide

and can file gc in whichever manner that client decides.

It is good to know details but the gc process should be done by good qualified attorney.

Do not try to do all this by yourself

good to know stuff and stay on top

Dont go to car mechanic and say \'change 3rd spark plug in car\'

tell car mechanic the problem and depend on him

same thing with lawyer - tell him ur problem and ask his advice

:) I can sense your message, but it is true with lot of good lawyers, not always or not with all lawyers. Agreed?
