PCC Requirements - My interpretation [IN BRACKETS]

Indian Police clearance certificates for the Immigrant visa interview should be obtained as follows:

1. All Indian IV applicants age 16 and above, residing in India, should obtain police certificates from the local passport office. These are usually more dependable than those obtained at a local level and indicate that the subject had no serious criminal convictions on record at the time of passport issuance. Applicants whose Indian passport was issued within the past six months may present just the passport office police certificate, and need not obtain additional police clearances.

[THIS IS FOR PEOPLE RESIDING IN INDIA and APPLYING FOR IV. SINCE PASSPORT ISSUE NEEDS PCC, IF THE ISSUE IS RECENT NO ADDITIONAL PCC IS REQUIRED]

2. Applicants over age 16 whose passports were issued more than six months previous to visa application must also obtain a police clearance from the district police office serving the applicant\'s place of residence.

[THIS IS ALSO FOR PEOPLE RESIDING IN INDIA. IF PASSPORT WAS NOT ISSUED RECENTLY, THEY WANT AN ADDITIONAL PCC TO COVER RECENT PAST]

3. Indian passport holders applying for visas outside India should obtain a statement from their local Embassy or Consulate confirming they have no criminal record.

[THIS IS THE ONE FOR CP. I READ THIS AS "INDIAN PASSPORT HOLDERS APPLYING FOR VISAS (RESIDING) OUTSIDE INDIA....". SO GET PCC FROM CONSULATE]

4. Non-Indian IV applicants residing in India should obtain police certificates from the district police station serving their area of residence.

[THIS IS FOR NON-INDIANS RESIDING CURRENTLY IN INDIA, WHO OBVIOUSLY CANNOT GET PCC FROM PASSPORT OFFICE, SINCE THEY DONT HAVE INDIAN PASSPORTS]

5. Indian police certificates are not available for foreign (non-Indian) applicants applying outside India.

[THIS SAYS INDIAN CONSULATE ABROAD WILL NOT ISSUE PCC EVEN IF YOU STAYED IN INDIA MORE THAN 6 MONTHS IF YOU ARE A FOREIGN NATIONAL]

I agree...

Seems pretty clear and is consistent with clarifications people have got from the Mumbai and Delhi consulates. Chennai has said PCC is not required. don;t know if they\'ve changed their stance now.

GET PCC FROM CONSULATE

The way I see it, 1 and 2 pertain to people residing in India, with passports issued within the last six months or earlier.

3 is for CP.. except the word "resident" is missing before outside

4 is for non-indians resident in India and 5 for non-indians, non-resident in India but doing CP there.

The sequence seems logical.

Further, in spite of what some lawyers in the US may say, passport office in India will not issue PCC if you are abroad and MOST police stations will not either.
