Paystubs-- 485 RFE time

It seems VSC is asking to submit paystubs w.r.t employment verification RFE's. Does anyone from NSC got an RFE to submit paystubs or just an employment letter from the company.

What are the ramifications if one doesnot have paystubs when an RFE was issued --> but being employed ... situations like employer still looking for job but not paying the employeee.

According to murthy's chat being an employee and not getting salary is not legal for both parties.... :(
 
I agree with sgavini, it is illegal and can have consequences. I don't think the adjudicater will buy that you were on a very long vacation. He will say that if the company didn't need you and let you be on a vacation then why would they file for your 485

You need to understand that long vacations is not a good idea. It simple won't work. INS is aware that some employers are using long vacations as a way to avoid paying salaries. It doesn't work that way anymore. Only maternal, sick leaves are acceptable to them. Nothing else.
 
I don't know whether it is a right thing or not, but discuss with your attorney...

Go to your home country and get a Doctor cerificate saying that you got sick and hospitalized for a long time. :)
 
Thanks for your suggestions everyone a friend of mine is on unpaid vacation and his ND is JAN lastweek so he's worried.
Looks like NSC is not asking for paystubs but a employer comfirmation letter but VSC is/was .... and he lives in VSC service Zone . IF BCIS transfers his app.. to VSC it is more problem .
If he changes his address now to NSC zone it might delay the process but it would be in NSC...
 
I got an RFE on 7/9 for employment verification. It clearly states submit a current letter or other evidence from the prospective permanent employer. No mention of pay stubs. I am not on any vacation and have all the pay stubs. Should I volunteer and send the pay stubs along with the letter or just send the letter? The general opinion of this board is not to send anything unless it is specifically asked for.

I know sending the paystubs wouldn't hurt anything but just dont want to take any chances. Any takers?

Just use the don't ask, don't tell policy. More documents you send, may confuse them. If they ask for EVL, just send them the EVL. Mine requested for the same thing and my HR lady sent EVL. Just my opinion.

fine. NSC is not asking any stubs specifically but some have volunteered them. I think with NSC it is better to stay away from volunteering any information.
 
As far as I understand it, GC is for a future job and it requires only a letter from the employer confirming the avalability of permanent employment upon confering the GC.

One need not show any pay stubs as one can legally stay in the US from the day one applies for one's I-485 even without employment. It is absurd to ask for pay stubs on the part of BCIS to this effect.

Technically agreed Sachdev. But if you browse VSC on rupnet for RFE 50% of them submitted paystubs.

Does INS has all the list of companies in their databases to pull information about company etc... info..
