Pay $$$'s to USCIS and Get your "PAID GC" , if VISA# is NOT available...!!!

Guys,
In the context of Retrogression, we are trying to lobbying. arranging rallies to Washington DC..etc..etc.. to get our GC...but can we think of GETTING GC by paying $$$'s to USCIS ?

Can we think of "Alternative" to above approach as follow?

Look guys, this is a CAPATALIST country & we have to give $$$'s to USCIS instead of wasting them on Lobbying, paying for EAD's & AP's...

"PAID GC" will work as follows:

Pre-processing condition:
If your I-140 is approved & you have filed I-485 and your I-485 is pending for more than 575 or 600 days (whats ever USCIS blah..blah..says) is mentioned against your case#.....

...THEN pay USCIS $2000 or $XXXX & get your "PAID GC" !!!

USCIS will assign temporary VISA# for such "Paid GC" and when VISA# will be available that VISA# will be assigned to your "PAID GC"..

SEVEN BASE RULES for "PAID GC":
USCIS process will continue as it is but USCIS will have some "BASE Rules". Before issuing "PAID GC" to you, USCIS will check their existing process of:
1. W2's & Income Tax paid by applicant for last 2-3 years
2. Copy of I-94 to ensure that I-485 applicant is Legally entered in USA
3. Name check is complete & applicant is NO longer a "threat" to National security
4. Finger Printing are OK & about complete 15 months
5. I-485 Primary applicant (his/her deravative) are completed their H1B extension 7 -8 year
6. I 485 applicant is repeatedlly applying for EAD's for more than 2 or 3 years
7. I-485 applivants Biomatric 2 (or 1,2,3) has been done at least one time

After applying this BASIC SEVEN THUMB rules, issue "PAID GC" to applicant & assign VISA# later whenever VISA# is available

Anybody wants to amend or add more THUMB rule, including $$ price for PAID GC?

Make EAD more than 1 year?

paid GC ... with temp visa number and all ... which might invovle an attorney who will charge a good amount to do the paper work.

Instead why not lobby to make EAD valid for say 5 years or 3 years ...
 
It would be a start of yet another queue???

Aren't you already done with the wait of State Labor, Federal Labor, I-140, I-485, EAD, AP and what not that now you are proposing to start yet another queue and another way of waisting time and hard earned money.

Trust me many more websites and forums will crop up helping you track your so called "Paid GC". Many more forms and lawyers will come up squeezing every penney out of your pocket.

In my opinion it would be worth to put in efforts and/or money (if required) to lobby for one time increase in Visa Numbers to clear up the back log. Also would be worth to make the process more efficient and reduce the number of stages required to finally get GC. This will ensure no backlog in future.

I can understand your noble intention but I think it would lead to a disaster.
 
Support this. At least there is assurance that you have the GC, unlike 5 yrs EAD

PAID GC would be issued like medicines - Over the Counter (OTC)

Guys,
My idea to get "PAID GC" is just like we are getting medicines "Over The Counter" - OTC.

This "PAID GC" will be issued at Local Application Service Centers where USCIS is stamping our passports/taking FP's etc...

Also, this "PAID GC" will NOT involve Lawyer (Liars) or attorneys because we are submitting our docs - Over The Counter at ASC.

I-485 applicant will approach nearest ASC and will carry following docs with him/her:
1. Copy of approved I-140
2. I 485 notice to show that you are really hanging around for more than 575 - 600 days ONLY because VISA# is not available for your country
3. Original - EAD/AP's
4. Copy of FBI Name Check clearance "e-mail" to show that Name-check is completed
5. Finger Printing completed, as well Biomat completion notice
6. His/Her Driving License/Passport

USCIS Guy at ASC will check/ensure:
1. Authenticity of all documentation we are presenting
2. "Intelligent Computer System" at ASC will generate a "Pseudo Random Number" depending on YOUR country (India, China, Philippines), Category - (EB3/EB1/EB2) and to this "Pseudo Random number" ASC guy will attach your A# and Priority Date.

In short, this "Temp PAID GC VISA#" is Unique Key which will consists of - Computer generated Pseudo Random Number + Country Type + Category (EB1/EB2/EB3) + your A# + PD Date (for EB3).

Every month "USCIS" computer system will look at published "VISA Bulletin DATEs" for different countries & EB categories and when it will match your PD date mentioned in your "Temp "PAID GC VISA#" then USCIs will call I-485 applicant and will ASSIGN NEW VISA# to your I-485 application and will delete your OLD "Temp PAID GC VISA#".

Its so simple. No Lawyers. Not to form any another "Queue" for "PAID GC"

Any Inputs..? How to sale this idea to USCIS? Thru AILA or thru Senators like Kennedy - McCain who are sympathetic to this "Pathetic" retrogression!

It is reasonable and agreeable to get a PAID GC if point 2 to is 180 days or over instead of 575 - 600 days

This idea is strictly conflict with immigration law.

What we can do is to raise our voice for the bill S. 1033 which will be discussed in Senate on 10/18/2005.

Just my 2 cents.

No I dont work for USCIS..Fiveice we are trying to break ice..!

We were not aware that among us there is guy who knows "conflicts in US Immigration law"!

Can you tell me/all forum members - How my idea (actually New I-485 Process) is conflicting Immigration Law?

Read this..USCIS is felxible to modify "Process" & also when it comes to get money..!

If one can file I-485 by paying $500 when Visa Number is not available then why we cant push for "PAID GC" through AILA or thru congressman/senators?

By getting "PAID GC", we will also get all the benfits of GC holder as some companies are reluctunt to accept EAD guys as their employee!

Any thoughts?

Paid Gc

I love your idea and definitely better for the future.

I'm in state of extending EAD and AP.

Everytime I'm loosing $1400 for these extensions for me and my wife.

($600 filing fees, $800 for the attorney charges where in world they require somuch for repeating the same stupidity).

I'm ready to go with your plan........ Atleat your post entertained, I hate the INS process and have been waiting from 2003 Jan (I-485 adjustment status RD : 4th Apr,2003).

You do not need an attorney to file the EAD and AP .. its simple and fast doing online. Of course it is more accurate when U do it Urself as U can double check all the entries U made... plus U get an immediate confirmation and the LIN numbers etc.
 
Your idea is fantastic but how to convince USCIS to buy your recommended process!!

Good idea to decrease waiting time but not sure on how USCIS will buy your recommandations!!

Guys...needs to work on this process & pressurize USCIS to buy this process!!
