Passport under the CCA

Anyone know or have experience on what specific documents the state department will need when applying for a passport under the child citizenship act? I'm asking as I rather get the documents now instead of waiting for them to ask me to mail supporting documents later unlike the CIS which they ask for all the relevant documents upfront.

Birth certificate of child
Naturalization certificate of parent
Green Card of child
Passport photos, of course. Child and both parents will have to go together to the post office, or wherever you apply for the passport. Don't worry, in this case the post office employee will make sure you have everything in order. I think you'll need to carry your ID too (both parents).

All originals, all documents will get stapled :eek:

I am not sure if you'll need marriage certificate in case you're sending the father's certificate. I am pretty sure with mother's certificate you won't need marriage certificate.

I am not sure whether the birth certificate needs to be translated.
 
in addition to those would you know of any other documents? think I saw a post where someone mentioned they asked for proof of legal custody, school records (no idea why on this one :P) etc etc

Most likely the marriage certificate will go with the app as my father is the citizen, mother isn't.
 
Both parents have to be present at the time of filing passport application. If both parents cannot be present then the missing parent has to send in a notarized statement about the custody of child. School records are not required.
 
well I'm over 18 now, just recently found out I qualified under the CCA :p

Are your parents divorced? Under CCA your naturalizing parent had to have legal custody of you before you turned 18. I am not sure what proof would be sufficient for the passport agency.
 
nope they aren't, which is why I was wondering if they wanted the marriage cert. at the post office instead of later.
 
I think they might need the marriage certificate at the post office. Take it with you when you go to the post office. If they don't need it you don't lose anything.

How Does the Child Get a U.S. Passport Under the Child Citizenship Act?
You will need the following when the child applies for a U.S. passport:

 Proof of the child’s relationship to the U.S. citizen parent. For the biological child of the
U.S. citizen this will be a certified copy of the foreign birth certificate (and translation if not
in English). For an adopted child, it is a certified copy of the final adoption decree (and
translation if not in English);

 The child’s foreign passport showing the Bureau of Citizenship and Immigration Services in the Department of Homeland Security (USCIS) I-551 stamp in the passport, or the child’s legal permanent resident card (green card);

 Proof of identity of the U.S. citizen parent(s)

 Evidence that the child was in the legal care and physical custody of the U.S. citizen
parent(s) (such as school records, medical records, or other evidence that the child was
under the care of the U.S. citizen parent(s).

Neither parent needs to be present if the individual is 18 or older. That part about both parents being present is to make it more difficult for one parent to remove the child from the US without the other parent's knowledge.

sorry that was the part I meant regarding evidence for the time frame before I turned 18
 
I think it applies to your case. You have to prove to the Department of State that you automatically derived citizenship through your parent/s. The way to prove it is the GC, your parent naturalization certificate and proof to satisfy that you were living in the USA under the legal and physical custody of your parent before you turned 18.

The way you have explained your case so far it shouldn't be too difficult to gather enough proof.

In general, it is much easier if parents take care of this before the child turns 18. In my child's case it was a simple affair, both parents and child showed up at post office with GC, birth certificate and naturalization certificate. The passport acceptance agent processed all our three applications with just two naturalization certificates (by making a certified copy of one of the certificates). No need for school records, medical records or anything else, as in this case the child is still under 18 and clearly under the legal and physical custody of the parents who are showing up at the post office. Your case is slightly more involved, but not much more. Worse comes to worse the passport acceptance agent will tell you if something is missing. Even in the worst case the passport agency will ask you for any additional evidence. Please let us know how it goes.
 
Aye, thanks for the help. I have contacted my school and seeing if they can send me my old records and go on from there. I should be applying within a few weeks so i'll keep you guys updated as I'm sure there are others with the same situation
 
Well I finally applied, a bit late but it was out of my control. I'll find out the results in a few weeks

After a few months of delays in getting the supporting documents my passport was approved and is being mailed

1. Not all the Post Office staff know about dealing with CCA passports.
2. You will need to submit child's application form (with pics etc), Birth Certficate in original, Green Card in original, both parents' ID copies, both parents' naturalization certificates in original (passport copies do not help).
3. Both the parents should goto post office. They will be asked to show their IDs and asked to sign on the forms.
