If one's passport has expired and has a new passport, how does this affect the Green card application? You have to carry both passports when you travel.

In the above scenario, I am assuming the old passport has the stamps and is used is all applications so far, i.e. H1, LC, 140, 485, EAD, AP.

If we file EAD/AP renewals now, do we have to submit copies of both passport, I think it would be safer. Any thoughts?

Carry both passports while you travel.

Send copies of both passports.
 
Hi Joyd:

Iam in the same boat, My old passport expired and I have applied for a new passport and got it. For my I-140 and I-485/765/131 I have submitted both passport copies and I always carry both of them.

Once you get your I-485 approval you can stamp the approval in new passport at that time you need not to carry the old passport...Till then keep the 2 babies together it is safe approach this my view...

To be on the safe side send both.

I am a concurrent filer 140/485(June2003) but applied EAD/AP only Mar 2004 as i had valid H1 till May 04. And about Feb 2002 my passport expired and i got a new passport issued from Indian embassy, DC. Now when I applied, my lawyer recommended that i send copies of both Passports because my old passport had the H1 that was expiring that was showing my current status and the new passport because that is the current travel document that i have. So i guess its always better to send both.
