Passport expiration/Visa issuance

My passport is expiring in September 2004, while my current H-1 B visa stamp is expiring on December 1, 2003.

Since I have a new H-1 approval valid till June 2006,

(1) Could I go to a border post before Dec 2003 to get a new H-1 stamp? If it is denied, could I still come back on my existing H-1?

(2) Would the fact that my passport is expiring next year be a problem getting a stamp valid until June 2006?

Note Visa is used for entering the country your stay here is defined by INS (or BCIS now) (basically the I-94 validity date)

For 1

Note if they do not put "cancelled without prejudice" stamp on your previous Visas then you can use that Visa to enter. (Not sure whether they will do this by default or not?)

For 2
Here I am not too sure how long will the Visa be but I am sure at the border post when entering the new I-94 will be valid only till your passport is valid (though your new H1 approval might be till 2006)
So you would need travel again outside the country once you have the new passport

(1) A new visa is stamped either by the consulate abroad or at St.Louis in US.
Visas are not stamped at the border post.
U need a new visa stamp to enter US, after dec 2003.

(2)Depends on when u want to stamp the visa.
Passport must be valid for min 6 months, when u apply for stamping.
