SOME REFUSED CASES MAY BE RE-OPENED




The Canadian Government has announced an important adjustment to the pass mark for skilled worker applicants. Effective immediately, the pass mark under the skilled worker category of immigration is reduced from 75 points to 67 points. In addition, all skilled worker applicants in the system who have not yet received a selection decision will be assessed against a pass mark of 67.



The Canadian Government has also announced new measures for assessing skilled worker applicants who applied for permanent resident visas prior to January 1, 2002. Those applicants will be assessed under the Immigration Act and Regulations in force at the time their applications were submitted. Applicants who do not qualify under the former Act and Regulations will be assessed under the current Act and Regulations against a pass mark of 67 points. Moreover, any applicant whose application was submitted prior to January 1, 2002, and who was refused between March 31, 2003 and June 20, 2003 can have his/her file re-opened and re-assessed under the Immigration Act and Regulations in force at the time the application was initially submitted. Applicants who do not qualify under the former Act and Regulations will be assessed under the current Act and Regulations against a reduced pass mark of 67 points.

If you submitted your application before January 1, 2002 and you have not received a final decision on your application;


Your application will be assessed under the Immigration Act and Regulations in force at the time your application was received by the Canadian Visa Office. If you do not score enough points to qualify under the former Act and Regulations your application will be assessed under the current Act and Regulations against a pass mark of 67 points.



If you submitted your application before January 1, 2002 and your application was refused between March 31, 2003 and June 30, 2003;


You may contact the Visa Office that handled your application and advise that office that you wish to have your file re-opened and re-assessed under the former Immigration Act and Regulations. If you do not score enough points to qualify under the former Act and Regulations your application will be assessed under the current Act and Regulations against a pass mark of 67 points.



If you submitted your application after January 1, 2002 and you have not received a final decision on your application.


Your application will be assessed under the current Immigration Act and Regulations against a pass mark of 67.



If you submitted your application between January 1, 2002 and June 28, 2002 and your application has been refused.
