Presently I am working on Full time H1B VISA. My employer wants to amend my H1B and file for a part time H1B as the company's economic situation is not good.
Do I have to work 40 hrs on my H1B to be in status or is it ok to work part-time with a single employer for less than 40 hrs? I was told that I could start working part time once I recieve the reciept notice from the INS ( ie within two weeks) and it takes about 4 months for the INS to make a decision. In the mean time while my application is pending with the INS, would there be any problem if a new employer is willing to do a full time h1 transfer? problem with part-time pay stubs for a full time H1 transfer? Would I be able to start immediately with my new employer with another such reciept notice. how does it work?
If there any potential problem for ME with my employer appliying for a H1 amendment to reflect my part-time?
What are my best options?
