Parents Visitor Visa Rejected:214(b) Advice Needed

Hi Senior members,

My parents attended an interview at Mumbai Consulate in September 2006. My father has mentioned in DS-156 that he is employed with 'abc' company since April 2006 as he just joined that company. (Father had employment and leave sanction letter from employer) So when consular officer looked at the date, she told how can you get a vacation for six months with your six months job? My father told her, he has a good relationship with owner. And after couple of question, she rejected visa for my parents on 214(b).

I am reapplying for them. And consular officer will definitely ask my parents why your visa got rejected last time. And I think they might have some kind of note in the system that says the rejection reason. So this time also my father has been working for 7 months with that company. Therefore, how can my parents present themselves so that they can get visa? One thing I can do, this time I can try to get visa for less than 6 months (say for 3 months). Is it worth to proceed in that way? I am afraid in doing so because consular officer might ask my parents why would you need visa for six months before and this time for 3 months only.

Please help me. It's urgent.

What your parents must be able to show and prove is


Strong emotional, financial and family ties to their home country

What reason was given for the denial? so we can suggest ways around it?

VO refused visa by saying how can you get a vacation for six months with your six months job?

My parents got all proof regarding financial and family ties. But VO didn't see a single document and rejected on 214(b) [Potential Immigrant].

I would appreciate any help from you.

In that case I would leave it 6 months and re apply for visa

So that you know, here is a statement from uscis


# section 214 of the INA states that every applicant shall be deemed an immigrant until such times as they prove to the consular officers statisfaction they are not#


So all the more reason it is important parents can prove

Strong, social, emotional and financial ties to home country

IN Us for every month of work you get one paid vaccation

As far as I know In USA for every month of work you get one paid vaccation.
This is how you accumulate your vaccations. There is no logical reasoning to get 6 months vaccation for 6 months of work.
You need to find a logical reasoning.

What else did they ask in the interview.
You need to prove that you are not an immigrant to the Consular Officer to get the non-immigrant visa. May be now he can show an official letter from the employer that he is willing to give him some time off from the job and he will be resuming the job after the visit.
