Background:

My parents first interview attempt at chennai was rejected by 214(b) based on the son and daughter are both greencard holders. They are both retired and live comfortably in India. They own a house and other properties in India. They have been to US couple of times before in 96 and 99. But both times they extended the stay by 4 months. Not sure if that made a difference in the rejection.

Questions:

1) I am trying to set up the second interview and am not able to get any date available till the end of december. If I select that they have not been rejected, then there are dates available in sep/oct. Anybody who has successfully scheduled second interview in Chennai recently, pls respond how you did it.

2) I came across a couple of posts saying that the sponsorer sent an affidavit from US saying that they will personally make sure that the visitors return back to India. Also, someone mentioned that the visitors submitted a sworn affidavit in front of a judge in India that they will return back. If anybody has done this, pls let me know if this succeeded.

3) Would appreciate any other tips in increasing the chance of success in the second attempt.

Thanks,

Rajesh

My mother applied and got visitors visa in Chennai early this year. She had previously visited us in 1999 and returned before her authorized stay expired and also did not extend her stay. I am a greencard holder. My mother (a widow) is not employed and lives alone in India.

My guess is that since your parents extended stay twice, this raises a huge red flag and violates the visitor visa presumptions.

A notirized letter under oath written by you stating explicitly that they will NOT extend stay this time will certainly help. An itinerary of their visit including confirmed return tickets also will help, as would any additional documents that prove your parents ties to India.

PLEASE DO NOT PROVIDE INCORRECT INFORMATION REGARDING THEIR VISA REJECTION. That in itself will be a ground for rejection again. Theywill have to wait for the December date and appear for interview.

Hi nkm,

Thanks for your response and suggestions.

The problem with the interview appointment is that there is no date available at all if you select that the interview was rejected once. The calender shows dates upto end of december and all the dates are in red (meaning no appointment). Since you have to enter a lot of information just to get to the calender page, it is a major pain just to keep checking the availability everytime.

I am sure there are some people in the same boat as I am and would love to hear from them how they setup the appointment for the second interview.

Thanks,

-Rajesh
