Parents Visa Rejected: Please HELP, URGENT

My wife's father was in the USA about 3 years back and that time he had his visa extended for 6 more months (he was here for 1 full year).

Y'day he went to the COnsulate for a new visa (his last visa for only 6 months) and the officer has asked him about his previous extension. He told him that he was approved for another 6 months for which he had asked for the approval notice. Unfortuantely, he does not seem to have that anywhere, so they have asked him to produce that before getting the visa.

My wife does not seem to have the approval notice or copy since we did not sponsor for his last visit, her uncle did that and he does not know where it is now. However, I am sure that he got his extension approved.

Now the question is: Is there a way to get a duplicate copy of the approval notice from USCIS ?.

Please help.

If you have atleast receipt number, then apply for the duplicate approval notice. It will take 2-3 months to get the duplicate approval. To apply duplicate approval Form I-824. If you don't have any information...I don't even know what to do.....

You do not need a duplicate copy of approval notice ever Receipt number might do.

1. If they had an attorney he can provide you atleast a receipt number if not approval notice. Which you can show it at Consulate. They can verify with INS.
2. If they have paid fees through the Check they can request bank give the copy of the encashed check. You can see receipt number back on the Check.

If you have a photo copy of your parent's I-94, you can call up USCIS and get extension information regarding that number. While extending visitor visa status, I-94 number remains same.
 
Use FOIA

Send FOIA request for all the required documents on your Father inlaw. For FOIA you do not have to give exact numbers, you can provide as much information as possible. USCIS will search for the documents and send the copies.

This issue has been rising up for the past few years. Parents/In Laws who come here on visit visa and extend it over the period of 6 months, dont get the visa that easily as US Consulates abroad consider this as a kinda of fraud for being in USA.

2 of my friends parents were rejected a couple of times and now they have lost interest in coming here again after going through all these hurdles.

Try with your attorney to see if he has the receipt number and I dont think that your uncle would have the check with the receipt number printed on back of it as its already 3 years now.

Good Luck! FOIA even takes 3 months minimum and even for that you need the receipt notice or how can they even track it out.

it is very easy. if you have the old I-94 or the #, call the USCIS and asked the copy of the approved extention.

There are two issues here.

  • Normally visitors get 6 months to visit here. It's not recommanded to extend visa unless there is someting serious that is beyond control - for example, health. Point to note that, if it is due to health or something other serious, probably the visit will extend 1, 2 or 3 extra months. But again, after getting 6 months extension, staying upto complete 1 year (6 + 6 months) clearly indicates otherwise.
  • In many cases, people apply for visa extension and assumes that it's going to be approved anyway. As a result, they never track or follow-up. That's a big mistake. In many cases, visa extension get rejected - especially tourist visa extension.
