I am a GC holder and my brother is a citizen. He filed the I-130 on 10/09/09 for my parents. They hold a turist visa that expires in 2014 but they can only stay in USA until 1/31/2010 according to their I-94.
1) Can we file the I-485 before the I-130 is approved?
2) If we file the I-485 before 1/31/2010, can my parents stay legally in USA after that date?
3) If they leave USA before 1/31/2010, how long they have to wait to come back?
