***Parents GC Application***

Hello All,
I’ve few questions based on two scenarios. Here is some brief information

My parents are coming to visit me in two week on tourist visa which is expiring on 15 June. I am a U.S. citizen and planning to apply for their G.C based on following Q’s. My parent has return ticket on August 10th 2006 (In four months). I am hoping they will get 6 months entry permit at the airport. :) Now here is my Q’s.

Scene 1)
I will apply for their I130, 485, I131, 865 and all other needed form for their G.C Application. Now my Q’s is how long it takes for I-131 advance parole to get approved? For San Jose (CA) center. What is the validity to stay out side U.S.A? What can one do to extend the validity of I-131?

Scene 2)
If I-94 entry permit is only allowed until 15th June (till their visa period) and they go back to India. I apply for their I-130 and not 485. How long it takes generally for Bombay consulate to process? Once approved what is the process? Do they get their GC in Bombay or they need to come here? If they need to come to U.S is thee any time limitation to come to U.SA or once can wait fro 2-3 year?

Thank you all in advance,
Sachin

Please refer to I131 processing dates for National Benefits Center on USCIS website to get some idea. Also the timelines of many users in the forum will give additional estimates.

I131 is usually valid for one year. However people advise that one should not be out of USA for too long. It is advisable to be back in USA in 3-4 months.

Under consular processing, total time taken depends on many factors: I-130 approval, time at NVC, time to schedule interview at Bombay. Please refer to GC for Parents sticky thread to get some idea. Under CP, their immigrant visa can be approved in Bombay but will have to enter US within 180 days to obtain GC.

Good Luck!
