I have very recently become a US citizen and now wish to file a petition for my mother for permannet residency. The problem is my mother entered the US on a vistor visa in 1999 and overstayed her visa and is thus currently out of status.
I have been reading some of the 245i laws which state that a parent of a US child atleast 21 years of age is able to apply for an adjustment of status in the US. Is this correct or does she have to physically leave the US ? There are also the 3 & 10 year bans on rentry for out-of-status applicants.
Any advice would be very helpful ?
