My situation is as follows:
1. I am with company A and have approved I-140.
2. I plan to join company B soon.
3. I am considering the option of transferring PD from company A to company B. I have good udnerstanding and cooperation from company A.
4. But I am thinking of having a backup plan. AC21 is not an option as my new job profile is very different than current one. A is ready to file my 485 and continue with it even if I leave them. My questions are :
* Can I file labor and I-140 with B if I have pending 485 with A ?
* Can I withdraw my 485-A if I want to file 485 through B ?
* If I decide not to file 485 through B and get a GC from A, do I absolutely need to leave B and go back to A ?
Sorry to bombard the forum with so many questions. But I look for your valuable input.
